1. Agreement to Terms
By accessing and using this website, you accept and agree to be bound by these Terms and Conditions. If you do not agree, please do not use the site.
2. Use of Website
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use and enjoyment of the site. Prohibited activities include: attempting to gain unauthorised access, introducing malicious code, scraping content, or interfering with site functionality.
3. Intellectual Property
All photographs, text, graphics, and content on this website are the exclusive property of Mohit Prasad and Moda Shutterworx and are protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without express written permission. Purchasing a print grants you personal display rights only, not reproduction rights.
4. Products & Services
We strive to display our photographs and products as accurately as possible. However, colours may vary between screen displays and final printed products. All prints are made to order. Sizes and materials are as described on each product page. Prices are in Australian Dollars (AUD) unless otherwise stated and are subject to change without notice.
5. Orders & Payment
Orders are accepted upon payment confirmation through our secure payment processor (Stripe). You agree to provide current, complete, and accurate purchase information. We reserve the right to refuse or cancel orders at our discretion, including for pricing errors or suspected fraud.
6. Shipping & Delivery
Prints are produced on demand. Please allow 10-15 business days for production before shipping. Delivery timeframes vary by location: Standard shipping within Australia is 5-10 business days; Express is 2-5 business days. International delivery typically takes 10-20 business days. Timeframes are estimates and not guaranteed.
7. Returns & Refunds
Given the custom-made nature of fine-art prints, returns are only accepted for damaged or defective items. You must notify us within 7 days of delivery with photographic evidence of the damage. We will offer a replacement or refund at our discretion. Digital downloads are non-refundable once accessed.
8. Limitation of Liability
To the fullest extent permitted by law, Moda Shutterworx shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or purchase of products. Our total liability shall not exceed the amount paid for the specific product giving rise to the claim.
9. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
10. Changes to Terms
We may update these terms from time to time. Changes take effect immediately upon posting. Your continued use of the website constitutes acceptance of the updated terms.
